How the EHCP process works

The EHCP process can feel impossibly complicated. Here’s a plain-English overview of what it involves and where EWL can help.

What is an EHCP?

An Education, Health and Care Plan is a legally binding document that specifies the educational provision a child with significant SEND needs is entitled to receive. It is produced by the Local Authority following a Needs Assessment. Once in place, the school must deliver what the plan specifies — it is not optional.

Needs Assessment Request

You or the school requests an EHCP Needs Assessment. The Local Authority has 6 weeks to decide whether to proceed.

Evidence Gathering

The LA collects reports from education, health and social care. A private EWL report strengthens your case significantly here.

Draft EHCP

If approved, a draft plan is issued. You have the right to comment, amend, and challenge provisions that are too vague or inadequate.

Final Plan & Review

The final EHCP is issued. Annual reviews must take place. EWL supports you at every review to ensure the plan stays current and effective.

Frequently asked

Can I request an EHCP assessment myself?
Yes. Any parent or carer can request an EHCP Needs Assessment directly from their Local Authority. You do not need the school’s permission or agreement. EWL can support you in making this request and providing the evidence needed.
What if the school says my child doesn’t need an EHCP?
Schools can discourage EHCP applications for various reasons, including resource concerns. Your child’s right to an assessment is independent of the school’s view. A private EWL report provides the independent professional evidence to support your application regardless of the school’s position.
When should we start planning for primary to secondary transition?
Ideally in Year 5 or early Year 6. Many families wait until Year 6 which leaves very little time. The earlier the planning starts, the smoother the transition. Contact Lauren in Year 5 for initial guidance — even if you’re not ready to formally engage yet.
What if our EHCP application is refused?
A refusal can be appealed to the SEND Tribunal (SENDIST). Lauren supports families through the appeals process as part of her EHCP service — helping you build the strongest possible case. Most families who appeal with proper professional support are successful.
Our EHCP is in place but school isn’t following it. What can we do?
If a school is not delivering the provision specified in an EHCP, this is a legal breach. EWL can support you in formally raising this with the school and Local Authority, and in escalating where necessary.
Is an EWL EHCP report accepted by Local Authorities?
Yes. EWL reports are written to EHCP Appendix 2 compliance standards and are accepted as evidence by Local Authorities. They carry the professional weight of a specialist SEND practitioner’s assessment.
